1. GENERAL

Please read and review these Terms of Use carefully before accessing or using the clinic locator (the “Locator”). By accessing or using the Locator and the websites under the control of Allergan Aesthetics, an AbbVie Corporation division, and its affiliates (the “Websites”,  the user (“You”) acknowledges that You have read, understood and agreed to these Terms of Use. 

2. USE OF THE LOCATOR

The Locator is a web-based service owned and managed by Allergan Aesthetics, an AbbVie Corporation division (including its affiliates, referred to herein as “AbbVie”) that enables You to search for medical practices and clinics that offer aesthetic services (the “Locator”).

AbbVie provides this service to You for informational purposes only in order to assist You with locating potential service providers in your area. It is not intended to promote the services of any particular location, and should not be considered as or relied upon as a recommendation of any particular services offered by a medical practice or clinic.

The Locator is made available to You free of charge. The medical practices and clinics included in the Locator do not pay any service fees to AbbVie for inclusion in the Locator.

The Locator does not constitute any form of partnership, co-marketing or co-promotion between AbbVie and the medical practices and clinics listed in the Locator.

The information contained in the Locator is not an offer to sell, or a solicitation of any product or service supplied by AbbVie or by AbbVie’s customers that use AbbVie products. The Locator is solely intended to serve as a directory of medical practices and clinics in Your area. AbbVie does not guarantee that any medical practice or clinic listed in the Locator will offer the specific aesthetic services or treatment options that You are interested in.

You will use the Locator in a manner consistent with all, applicable laws,. If You violate any restrictions in these Terms of Use, You agree to indemnify AbbVie for any losses, costs or damages, including reasonable legal fees, incurred by AbbVie in relation to, or arising out of, such a breach, to the extent permitted under applicable law.

Your access to and use of the Locator may be changed, restricted or terminated by AbbVie by notice with immediate effect at any time and whatsoever reason.

Although AbbVie does not assume responsibility for monitoring or editing material published in the Locator, if any inappropriate content or material is brought to its attention, AbbVie, at its discretion, reserves the right to take appropriate action to edit or, if necessary, remove any such content.

3. EXCLUSION OF WARRANTIES AND LIABILITY

You acknowledge that the Locator is provided on an ‘as is’ and ‘as available’ basis. AbbVie excludes all warranties as to the satisfactory quality, fitness for a purpose, freedom from computer viruses and non-infringement of third-party rights regarding the Locator, to the extent fully permitted by the applicable laws.

You understand and agree that by listing any individual medical practice or clinic  or by publishing any of the information that relates to the operation of such medical practices or clinics, AbbVie does not endorse, certify, assess, promote, support or otherwise recommend You to consult or use the services of any of such practices and clinics. The inclusion of a medical practice or clinic in the Locator is not a representation by AbbVie that any of the health care professionals that may practice at these locations are qualified, capable or skilled to provide You with the aesthetic services or outcomes You expected.

You should discuss Your aesthetic interest and potentially suitable treatments only with qualified health care professionals, and should ensure that You have gathered sufficient and satisfactory information before making a decision about where to receive aesthetic services.

Any information and/or other content You have accessed and used while using the Locator is entirely at Your risk, and You bear the entire responsibility for any costs, damages, losses, or claims that You may experience because of Your use of the Locator.

AbbVie relies on publicly available business information of the practices and clinics that appear in the Locator. AbbVie disclaims any liability with regards to accuracy and reliability of such information.

AbbVie will not be liable for any direct or indirect, special, incidental, or consequential loss of profits, revenue, contracts or goodwill resulting from the availability or interruption of its Websites or from work stoppage, computer failure, computer viruses, loss of data or in any other respect whatsoever from the use of this site.

4. INTELLECTUAL PROPERTY

The copyright in material and content in the Locator is owned or licensed to AbbVie and protected by  copyright and other intellectual property laws.

All product names, logos and services appearing on the Websites that are identified by ® or ™ or appearing in type form different from that of the surrounding text are trademarks owned by or licensed to AbbVie or our affiliates, unless otherwise identified as being owned by another entity. The use of these trademarks by You is prohibited unless special permission has been granted in writing by AbbVie. The display of any trademark or trade name not owned by us on our Websites  does not imply that any license has been granted by its owner. No trademark infringement is intended, and no suggestion is made that the owner of the trademark or trade name endorses AbbVie’s products or services. Equally, AbbVie’s display of the trademark or trade name does not constitute an endorsement or approval by it of the trademark or trade name owner, its web site or its products or services.

5. PRIVACY

AbbVie complies with the Federal Personal Information Protection and Electronic Documents Act (PIPEDA) (and any successor thereto) and any other applicable personal information protection legislation. All personal information voluntarily provided to AbbVie via the Locator shall be processed in accordance with its Privacy Policy. The usage of the Locator does not require You to provide any personal information to AbbVie, however we recommend You review the privacy statement relating to the AbbVie website in which the Locator is included.

6. MISCELLANEOUS

If any part of these Terms of Use is declared invalid for any reason by a court of competent jurisdiction, this will not affect the validity of any remaining part of the terms. Any such remaining part will remain in full force and effect as if the invalid part of the terms had been eliminated.

AbbVie reserves its right to modify the Locator and these Terms of Use at any time without prior notice. By accessing and using the Locator, You will be automatically bound by any such changes and should, therefore, periodically visit this page to review the current terms and conditions.

The Locator is operated under the laws and regulations of Canada. The laws of the Province of Ontario and the Federal laws of Canada applicable therein will control these Locator Terms of Use to the extent that the laws of the Province of Ontario are not overridden by applicably mandatory local law, e.g. consumer protection laws applying to You. The site is intended to be used by residents located in Canada only.
